This Dispute Resolution Policy ("Policy") outlines the procedures for resolving disputes related to the GoWagr platform ("Service") provided by Trence Technologies ("Company"). By using the Service, you agree to comply with this Policy.
Resolution Overview
If there's any disagreement between parties regarding the outcome of a wager, GoWagr provides a dedicated dispute resolution service. Users are encouraged to reach out to our Dispute Resolution Team in such instances. This team, consisting of trained Dispute Resolution Administrators, is committed to addressing and resolving any issues as swiftly and fairly as possible. Upon initiating a dispute, the involved parties will have their concerns thoroughly reviewed by our administrators, who will employ a fair and balanced approach to find a resolution. We prioritize a prompt response to ensure that any uncertainties or conflicts are resolved efficiently, aiming to maintain a positive and fair wagering experience for all users.
Initiation of Dispute Resolution
a. If a party feels that the conditions of a claimed wager have not been adequately fulfilled, they may contest such claims and put it through the dispute resolution process. Contested wagers must be based on genuine concerns regarding the fulfilment of the wager requirements or terms.
b. When contesting a wager, the party must provide a detailed explanation to the dispute admins, including the specific wager details and terms, relevant evidence, and any supporting documentation. The dispute resolution process aims to provide a fair and unbiased evaluation of the appeal.
c. When resolving disputes, the basis for our decision-making is the original terms set during the creation of the wager. If the parties involved in the wager have deviated from these initial terms by forming a separate agreement outside of GoWagr's established framework, our Dispute Resolution Administrators have the authority to dismiss the wager.
Prohibition of Illegal Activities
a. The Company strictly prohibits the use of the Service for any illegal activities, including but not limited to fraudulent, deceptive, or unlawful actions. Any wager or activity that violates applicable laws, regulations, or ethical standards is strictly prohibited and may result in the termination of the user's account. The Company reserves the right to report any suspected illegal activities to the appropriate authorities.
b. The use of derogatory, abusive, insulting, or any form of curse words, while a dispute resolution procedure is prohibited. Such wager dispute is highly susceptible to an immediate dismissal & user(s) exhibiting such behaviors would indefinitely have their accounts suspended.
Evidence Submission
a. In the event of a dispute, both parties agree to submit evidence of the fulfilment of wager conditions to the dispute resolution administrator in PDF, PNG or JPEG format. The evidence should clearly demonstrate compliance with the agreed-upon terms and conditions of the wager.
b. The dispute resolution administrator will carefully review the submitted evidence and documentation to make an informed decision. Parties may be required to provide additional evidence or information to strengthen their case if deemed necessary.
c. The dispute resolution administrator will evaluate the evidence based on the preponderance of evidence standard, which means the decision will be based on the greater weight of the evidence presented by each party.
Wager Requirements
a. Users placing wagers are responsible for ensuring that the requirements for the wager are clear, unambiguous, and specific. The wager details should include the subject matter, terms, conditions, and any other relevant information necessary to define the scope of the wager accurately.
b. Users accepting wagers must fully understand the wager requirements before accepting. It is essential to review the terms, conditions, and specifications of the wager to avoid any misunderstandings or disputes.
c. Wagers should have easily verifiable sources to ensure transparency and fairness. Users should rely on credible and reputable sources of information when creating and accepting wagers.
d. In the event that a wager cannot be easily verified after reasonable attempts have been made to resolve the dispute, the wager will be marked as unsolved, and both users will be refunded their respective wager amounts.
e. For users who use GoWagr for gaming challenges, In the event that dispute resolution evidence is not clear, easy to interpret, or adequate from both parties, dispute resolution admins reserve the right to dismiss such wager and return stakes to both parties.
Appeals Fees and Additional Costs
a. Where an appeal is raised for a dispute, GoWagr seldom charges an additional 5% fee in addition to the standard 5% fee already charged for wagers registered on our platform, regardless of whether the dispute is resolved or not. This fee covers the administrative costs associated with the dispute resolution process.
b. The Company may also decide to charge additional costs if the verification procedure requires more time and resources than initially anticipated. Users will be notified of any additional costs, and their consent will be obtained before proceeding with the resolution process.
Review and Adherence to the Agreement
a. Users are advised to thoroughly review this Agreement and adhere to its provisions when creating and accepting wagers on the GoWagr platform. By using the Service, users acknowledge their understanding and agreement with the terms and conditions outlined herein.
b. Any violation of the terms and conditions, including attempts to manipulate the wager outcome or engage in fraudulent activities, may result in account suspension or termination.
Governing Law and Jurisdiction
a. This Dispute Resolution Policy shall be governed by and construed in accordance with the laws of the United States of America, where our company is domiciled. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the courts in the United States, having exhausted the dispute resolution options stated in our Terms of Service.
Severability
a. If any provision of this Policy is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
